Preamble

The MDT provides a program through which Service Providers can undertake training and assessment of candidates ensuring that the standards are uniform country wide and are consistent with good educational practice.

 The disciplinary policy is intended to:

bullet

Ensure Service Providers can be held accountable for their actions with regards the MDT training programme.

bullet

Ensure the MDT is not brought into disrepute through the poor performance of Service Providers.

bullet

Prevent mis-representation of the MDT or its programmes by Service providers or other persons.

bullet

Ensure that good principles of training and assessment are maintained in all MDT programmes.

 Process

The MDT regards any breach of its policies and procedures as serious, and as such has established the following process to deal with breeches of policy and process.

1)    On identifying as possible breach in policy or procedure, the MDT will appoint a person/s to investigate the incident and gather pertinent facts relating to the incident.

2)    Once sufficient facts have been established, a report will be presented to the Trustee represented on the Natcom.

3)    The Trustees will decide whether to:

Request additional details

bullet

Disregard the report

bullet

Issue a warning

bullet

Issue a temporary suspension &/or

bullet

Hold a formal enquiry

 4)       Should a formal enquiry be required, the Trustees will either:

bullet

Act as disciplinary board members

bullet

Appoint Natcom members to act as disciplinary board members

bullet

Appoint an external person/s as disciplinary board members

 5)       At any formal enquiry, the accused person/s involved will be given the opportunity to represent themselves in person & or writing, to explain their actions and answer to any accusation.

 6)       Should the accused person/s involved be found not to have done any wrong, the disciplinary committee will record such in writing and provide the person/s with a copy of such.

 7)       Should the accused person/s be found to have breached any policy, procedure, standard or have mis represented the MDT in any way, the board will either:

Issue a letter of warning to the accused

bullet

Suspend the accused for a defined period of time, not exceeding one year

bullet

Permanently revoke Service provider status

bullet

Refer the matter to legal council or the SAPS for further legal action where a law of the country has been contravened

bullet

Where the board feels it is necessary, provide details of the incident on its official website, and notify affected persons.

 8)       The disciplinary board may recommend that corrective action be taken at the accused person/s expense, with regards training or assessment that has as a result of this breech, disadvantaged a candidate/s.

 9)         The accused may have the right to appeal to the Disciplinary Board
